Two Village Trustees, Brown & Medelis, Targeted for Recall

Two Village of Newberry trustees that are also members of the Newberry Water and Light board have had recall petitions brought against them by two village residents. Charles “Buzz” Medelis is being targeted Mike Schnorr and Sharon Brown by Mike Winn.

In order for a recall petition to go forward, there must be a clarity/factual review. Such a clarity hearing was held May 2 before Clayton Graham, Luce County Probate Court judge. The language for the petition on each, as reproduced below, was denied based on clarity.

A second petition to recall was filed shortly afterward. The clarity/factual review for these recall petitions will be held May 16, again in front of Judge Graham.

If the recall petition language is approved, enough petition signatures need to be gathered. The minimum amount of signatures required would be 25 percent of the votes cast for all candidates running for Michigan Governor in the last gubernatorial election.

Those that sign the petition must be registered to vote within the village. The signatures need to be verified and then can be challenged.

If the signatures are validated and a recall election is held, the incumbent is automatically on the ballot, and anyone eligible to run for the office must have a nominating petition signed and turned in within 10 days after the call for a recall.

If the recall petition is successful, the election would be held in November.

The first petition language against Charles Medelis:

“Charles Medelis served as Trustee on the Newberry Village Council during 2017 and the first quarter of 2018. Charles Medelis served as Board Member on the Newberry Water & Light Board during 2017 and the first quarter of 2018.

“Charles Medelis motioned that effective August 1, 2017, the base water rate will change to a flat rate of $75 per month for residence per REU (Resident Equivalent Unit). The motion carried. The Village Council adopted a 2018 Budget Resolution for the General Fund, Special Revenue Funds, Capital Project Funds, and Fire Funds on January 3, 2018. Charles Medelis voted for the motion.

“The Village Council approved the 2018 Water Budget, the 2018 Electric Budget, and accepted the 2018 Sewer Budget on March 19, 2018. Charles Medelis voted in the affirmative for each motion to approve and/or accept the respective budgets. For the above reasons, Charles Medelis should be recalled.”

First Petition Language against Sharon Brown:

Sharon Brown served as Trustee on the Newberry Village Council during 2017 and the first quarter of 2018. Sharon Brown served as Board Member on the Newberry Water & Light Board during 2017 and the first quarter of 2018.

The Second Petition Language against Medelis and Brown, tightened up but changed little, included the charge that as a result of their votes “the Village operated without approved budgets, contrary to Michigan State Law.”
